1. General

The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, and to guard that information against loss, misuse, or alteration.

2. Types of information we collect:

‘Personal data’ includes all information that pertains to an identified or an identifiable natural person. Such can, in particular, include, but is not limited to: name, date of birth, email address, telephone number, and gender.

2.1 Use of the website and of the Closed online shop

To the extent that you make use of the offers provided on our website and place orders in the Closed online shop, it will be necessary for you to provide personal data. These data are what the respective transaction requires. The processing of your data is effected for the purpose of rendering the service you want, such as sending you the desired email newsletter or carrying out the order in the Closed online shop, and making information available in your Closed online shop customer account. Closed will process your personal information in the scope described below.

2.2 Informational use of the website

Generally, it is not necessary for you to furnish personal data just to visit our website or the Closed online shop (informational use). Apart from such, (2.3) through (2.6) shall apply.

Rather, in this event Closed will process only those data that your internet browser automatically transfers to us, e.g.:

  • date and time of the retrieval of one of our websites
  • the requested site and method
  • the type of browser used
  • the browser settings
  • the operating system used
  • the site most recently visited by you
  • your IP address and the port
  • as well as any additional transfer-relevant parameters

We process these data (i) in order to enable or to optimize use of the internet sites retrieved by you, (ii) for statistical purposes, and (iii) to improve the offerings of Closed on the internet. We store the IP address only for the duration of your visit to our website or the Closed online shop; no personal evaluation takes place.

Our website is operated by (hosted at) Telekom Deutschland GmbH, Landgrabenweg 151, D-53227 Bonn, Germany, so that the data mentioned here are transferred for operation of our website to Telekom Deutschland GmbH.

2.3 Ordering with customer account

On this website, Closed offers you the opportunity to set up a customer account for the Closed online shop. You can store your personal information here for orders in the Closed online shop, in order to be able to order more conveniently and more quickly in the future. At the same time, service information will be kept ready for you in your personal customer account, e.g., access to your purchasing history.

When your customer account is registered, Closed will set up password-protected access to your personal master data (particularly salutation, name, address, date of birth, telephone number, email address) and ordering data (e.g., goods, payment dates, shipping service providers).

By setting up a personal customer account, you hereby consent (Article 6(1)(a) of the General Data Protection Regulation, the “GDPR”) to having Closed store the deposited master and ordering data and connect it with your customer account.

You can rectify or erase the data in the customer account yourself at any time. Moreover, at any time you can revoke the above consent for setting up a customer account and have the Closed customer account erased. To do so, you only have to send Closed the relevant declaration in the text-form (see “Contact us”), and no costs will be incurred aside from any ordinary transmittal costs of the communication method you choose. Closed will then promptly erase your customer account. Please note that through the erasure, only the customer account and the information connected to it are erased, and that the erasure does not pertain to the order transactions and to the actual personal data stored concerning placed orders.

Closed processes the personal data provided by you to maintain the customer account until such time as it is erased. The personal data that are stored in connection with an order from Closed are processed by Closed in fulfillment of the contract entered into with you or to carry out pre-contractual measures (Article 6(1)(b) GDPR) and accordingly are further stored in the customer account; apart from that, they are erased, to the extent that retention is not prescribed by law. In the latter event, the data are erased upon expiration of the retention period.

Ordering “on account” shall be possible after the initial order is successfully processed.

2.4 Ordering as guest

If you wish to use the Closed online shop without a personal customer account, then you can also place an order as a guest. To do so, in each instance the necessary personal master and ordering data that are part of the ordering procedure have to be entered on the online order form from the Closed online shop. Here, the same data are processed as when a personal customer account is set up.

The personal data that are processed in connection with an order placed as a guest of Closed are processed by Closed in fulfillment of the contract entered into with you or to carry out pre-contractual measures (Article 6(1)(b) GDPR) and are erased afterwards, to the extent that retention is not prescribed by law. In the latter event, the data are erased upon expiration of the retention period.

Ordering “on account” is not possible.

2.5 Transfer to third parties when ordering

Closed transmits the necessary data to Fuljoyment AG (Heinrich-Seidel-Strasse 5, D-19071 Brüsewitz, Germany) in order to process your order (packaging, shipment, processing any returns, processing payments for payment methods). The processing is effected upon the basis of Article 6(1)(b) GDPR. Fuljoyment AG transmits the name and address to DHL Express in order to enable the goods ordered by you to be delivered.

For calculation of taxes and duties for US orders, Closed transmits the necessary data (name, address, and the order details) to AVALARA, Inc. (255 S. Kind St. Suite 1800, Seattle, WA 98104, United States of America) for processing your order.

For payments via credit card and PayPal Closed transmits the necessary data to BS PAYONE GmbH (Lyoner Strasse 9, D-60528 Frankfurt am Main, Germany) for processing your payment (Article 6(1)(b) GDPR).

2.6 Newsletter

If you have registered for the Closed newsletter, Closed uses your data provided at the registration exclusively for the purpose of sending the Closed newsletter (Article 6(1)(b) GDPR).

Users who no longer wish to receive our newsletter or our promotional emails can click on a link entitled “UNSUBSCRIBE,” which is contained in all emails sent by Closed. The personal data specified by you at registration will then be erased by Closed.

For purposes of sending the newsletter, Closed transmits your email address to MailChimp (The Rocket Science Group LLC, 675 Ponce de Leon Ave NE, Ste. 5000, Atlanta, George 30308 USA).

2.7 Deployment of cookies

Closed uses cookies on this website and for the Closed online shop. These are small text data files that are sent by the webserver to your browser in the course of your visit to these internet sites or to the Closed online shop and are held on your computer for retrieval at a later time.

You can determine yourself, by adjusting the settings in your browser, whether cookies can be implemented and retrieved. For instance, you can completely deactivate the storage of cookies in your browser, restrict it to certain websites, or configure your browser in such a manner that it automatically notifies you as soon as a cookie is supposed to be implemented and requests a response from you. Closed wishes to note here that you have the right to receive access, at any time and at no charge, to any stored personal data about you. Additionally, at any time you can revoke, effective for the future, any data-protection consent issued to Closed. Equally, at any time you can demand the erasure, rectification, or restriction of processing of the personal data of yours stored at Closed.

You are entitled to the right to data portability and the right to object. For any questions concerning the collection, processing, or use of your personal data and concerning the assertion of your rights, please contact us (see “Contact us”). With regard to the processing of your personal data, you also have the right to approach the responsible data protection authority – the Hamburg Commissioner for Data Protection and Freedom of Information.

Pursuant to California Civil Code Section 1798.83, users who are California residents can request certain information about the sharing of their own personal information with third parties for direct marketing purposes during the past year. The information which you have a right to receive includes the categories of personal information disClosed by us for direct marketing purposes during the preceding calendar year and the names of the companies that received such information. 5. Email about availability (‘Back in Stock/Coming Soon’)

On our website, we offer you the subscription of an email-service informing you about the availability of sold-out or not yet available goods. For this purpose, we process your email addresses and send you a message as soon as the product you requested is available for purchase again. If you do not have a customer account with us, you will receive a confirmation email in advance to verify the email address. The legal basis is Art. 6 para. 1 letter b) GDPR, as we store your data solely for sending the notification you have ordered. Your data will be stored until the product is available and then deleted unless you subsequently open a customer account with us. Please note that our notification does not constitute a reservation of the respective product.

8. What happens with my information if the Closed Direct GmbH or its assets are sold?

It is possible that, at some time in the future, our company may be sold along with its assets, or may engage in business transactions in which customer information is one of the assets transferred. In such a case, the customer information which we have gathered may be one of the business assets we transfer.
